PLEASE READ THE AGREEMENT CAREFULLY BEFORE SIGNING. ONCE SIGNED, IT IS ASSUMED THAT THE AGREEMENT HAS BEEN READ AND FULLY UNDERSTOOD BY

THE PARTICIPANT/PARENT/GUARDIAN.

This agreement (herein referred to as the “Agreement”) contains information on established conditions of participation in our diving, snorkelling, and other watersport

activities. The participating individual (herein reffered to as the “Participant”) is required to sign this Agreement. Therefore, kindly read and clarify your queries prior to

signing. We will not be liable for any incidentthatis covered by the conditions of participation once you have signed.

If the Participants below 18, this form must be signed by a parent or a legal guardian.

RELEASE OF LIABILITY, ASSUMPTION OF RISK, WAIVER OF CLAIMS & IDEMNIFICATION NOTICE

CONDITIONS OF PARTICIPATION –GENERAL, WATERSPORTS AND EXCURSIONS

1.I hereby assume and undertake all risks of injury and / or harm associated with the use of the snorkelling and diving equipment and agree to indemnify and forever

release Sub Oceanic Adventures Private Limited (“Sub Oceanic”), its staff and employees, Hilton Amingiri Private Limited (the “Hotel Owning Entity”), Hilton Maldives

Amingiri Resort & Spa (the “Hotel”), its staff and employees from any liability, claims or demands related to but not limited to any potential injuries and / or harm, either

physical or mental, and / or loss of life caused in connection with the use of the snorkelling and diving equipment and by engaging in snorkeling and diving. By signing this

condition of participation, I undertake allrisks attached to snorkeling and diving on my own.

2.The Participant acknowledges that he/ she shall strictly follow the directions and instructions of the guide / instructor / dive master, including but not limited to,

minimum certification / ability / level of training requirements, area of activity, time frames and passenger limits. Participants engaging in watersports shall stay clear

and give way to the swimmers, snorkelers and divers as and when instructed by the guide / instructor / dive master or he / she may be debarred from any activity without

being entitled to a refund. Failure to follow instructions given by the Sub Oceanic staff will constitute as the Participant acting on his / her own risk.

3.The Participant shall stay within the sight of the guide / instructor / dive master when conducting any independent watersports activity. The independent visit of other

islands, sandbanks or reefs by means of catamaran, surfboard, canoe, etc. is not permitted. For equipment rescue, Sub Oceanic reserves the right to charge a minimum of

US$ 40.00 (forty United States Dollars).

4.The Participant is 100% liable for any damage caused on material and people including himself /herself and /orloss of equipment, material and safety tools whereby Sub

Oceanic is entitled to charge forloss of earnings in addition to the repair or renewal costs.

5.The Participant shall check all equipment and material before use and immediately report any defects or malfunctions to the SubOceanic team.

6.Any defects/damages found afterthe equipment being used by the participant, shall be treated as defined in clause 4.

7.The rental of windsurfing, kitesurfing equipment and the catamarans require a basic skill set and the Participant will not be allowed to teach himself/herself and others

for safety reasons.

8.The Participant confirms that he/she is able to swim independently without flotation devices for a minimum of 15 (fifteen) minutes and is competantly trained to

participate in the interested activites.

9.The Participant declares that he/she doesn’t have any severe underlying physical or mental conditions which affects or could affect his / her ability to conduct chosen

activities.

10.The Participant agrees to wear a life vest during the activities at alltimes.

11.The Participant declares that he/ she has been given a location and safety briefing and is aware of the location where watersports are permitted, in addition to

emergency procedures.

12.Payment is made directly with the enrolment for an activity. Kindly note that under our cancellation policy: all activities cancelled after 18:00pm on the day before will

be charged 50% of the price, cancellations on the same day will be charged 100%. Should participants discontinue an activity no reimbursements shall be made. If the

maximum rentaltime as defined by the price listis exceeded, Sub Oceanic reserves the rightto charge for extra time.

CONDITIONS OF PARTICIPATION – JET SKI

1.Minimum age of renting a jet ski is 18 years. Drivers must be a minimum 16 years of age and the engine shut off lanyard needs to be attached to the adult. Minors must be

accompanied by an adult at all times.

2.Maximum amount of participants on a single jet ski is 2 (two) and the weight limit must not exceed 240kg.

3.All operators agree to wear the lanyard-type engine cut offs attached to himself or herself or the personal flotation device. All safety equipment is provided free of

charge.

4.Careless and negligent operation of the jetski without due caution, exceeding the allowed speed limit and/or endangering another person, boat or property is strictly

prohibited. This includes but is not limited to following a boat, a skier or fun tube at a distance of less than 60 meters or weaving through congested traffic. The

Participant shall always maintain a safe distance with anotherjet ski and avoid engaging in reckless behavior.

5.Participant declares that he/she shall appear 15 minutes before the reservation and confirm that he/she has been given a location, operations and the safety briefing

inclusive of but not limited to:

a.The designated ‘Jetski Riding Area’ and thatthe Participant must stay within these designated boundaries at all times.

b.No jet ski shall be operated within orthrough a designated bathing, snorkelling or diving area inclusive ofthe lagoon.

c.Participants must keep a safety distance no less than 60 (sixty) meters with reefs and other prohibited areas

d.If in trouble,the Participant shall cross his/her arms overthe head and wait for an employee of Sub Oceanic to come and rescue.

CONDITIONS OF PARTICIPATION – FLYBOARD, JETPACK HOVERBOARD, PARASAILING

Release and Waiver of Claims; Assumption of Risk; Indemnification Notice

In consideration of being allowed to use the facilities and participate in Flyboard, Hoverboard, and Jetpack Instruction, Parasailing and other activities (collectively

referred to as the "Activities") provided by Sub Oceanic Adventures Pvt Ltd ("Sub Oceanic"), the participating individual (herein referred to as the “Participant”), and the

Participant's parent(s) or legal guardian(s) if the Participantis a minor, do hereby agree, to the fullest extent permitted by law, as follows:

1.TO WAIVE ALL CLAIMS that they have or may have against Sub Oceanic Adventures Pvt Ltd ("Sub Oceanic"), its staff and employees, Hilton Amingiri Private Limited

(the “Hotel Owning Entity”), Hilton Maldives Amingiri Resort & Spa (the “Hotel”), its staff and employees arising out of the participant's participation in the activities or

the use of any equipment provided by Sub Oceanic (“Equipment"), including while receiving instruction and/or training;

2.TO ASSUME ALL RISKS of participating in the Activities and using the Equipment, even those caused by the negligent acts or conduct of Sub Oceanic, its owners,

affiliates, operators, employees, agents, officers, and/or any entity to which Sub Oceanic owes a contractual indemnification obligation. The Participant and his/her

parent(s) or legal guardian(s) understand that there are inherent risks of participating in the Activities and using the Equipment, which may be both foreseen and

unforeseen and include serious physical injury and death. Sub Oceanic, its staff and employees, the Hotel and its staff and employees believe that the participant is fully

aware of the risks associated with the Activities and shall not be liable for any injury or death arising out of such conduct;

3.TO RELEASE Sub Oceanic, its owners, affiliates, operators, staff, employees, agents, officers, and/or any entity to which the Sub Oceanic owes a contractual

indemnification obligation from all liability far any loss, damage, injury, death, or expense that the Participant (or his/her next of kin) may suffer, arising out of his/her

participation in the Activities and/or use of the Equipment, including while receiving instruction and/or training. The Participant and his/her parent(s) or legal

guardian(s) specifically understand that they are releasing any and all claims that arise or may arise from any negligent acts or conduct of Sub Oceanic, its owners,

affiliates, operators, staff, employees, agents, officers, and/or any entity to which Sub Oceanic owes a contractual indemnification obligation, to the fullest extent

permitted by law. However, nothing in this Agreement shall be construed as a release for conduct thatis found to constitute gross negligence or intentional conduct;

4.TO DISCLOSE any physical or mental health condition that might prevent the Participant from engaging in the Activities. Sub Oceanic shall not be responsible for any

injury and/or harm caused due to the negligence of the Participant in disclosing information and/or intentional concealment of information and similar

misrepresentations.

5.TO INDEMNIFY Sub Oceanic, its owners, affiliates, operators, staff, employees, agents, officers, and/or any entity to which Sub Oceanic owes a contractual

indemnification obligation, from all liability for any loss, damage, injury, death, or expense that the Participant (or his/her next of kin) may suffer, arising out of

participation in the Activities and/or use ofthe Equipment, including while receiving instruction and/or training.

PERSONAL RESPONSIBILITY FLYBOARD, JETPACK HOVERBOARD

1.The Participant and his/her parent(s) or legal guardian(s) certifies that Participant has no physical or mental condition that precludes him/her from participating in the

Activities and that he/she is not participating against medical advice.

2.The Participant and his/her parent(s) or legal guardian(s) understand that the Participant's participation in the Activities is voluntary and further understand that they

have the opportunity to inspect Sub Oceanic Equipment and facilities priorto the commencement of the Activities.

3.The Participant and his/her parent(s) or legal guardian(s) understands that the Participant is obligated to follow the rules of the Activities and that he/she can

minimize and negate his/her risk of injury by exercising reasonable care and diligence by being cautious of his/her surroundings.

4.If, while participating in the Activities, the Participant or his/her parent(s) or legal guardian(s) observes any unusual hazard or condition which could jeopardize the

personal safety of the Participant or that of others, the Participant and/or his/her parent(s) or legal guardian(s) shall immediately stop the Activities and urgently inform

the Sub Oceanic staff.

PARASAILING RELEASE OF LIABILITY, WAIVER OF CLAIMS, EXPRESS ASSUMPTION OF RISK ASSOCIATED WITH PARASAILING AND RELATED ACTIVITIES AND

INDEMNITY AGREEMENT

I hereby affirm and acknowledge that I have been fully informed of the inherent hazards and risks associated with parasailing and related water sport activities to which I

am about to engage.

DECLARATION OF FITNESS TO PARASAIL:

I hereby declare that I am physically fit and that I am not suffering or have suffered from any of the following conditions that could potentially endanger myself or others

whilst Parasailing such as but not limited to:

I hereby declare that I have no physical or mental condition that should preclude me from participating in my chosen activity, that I am not participating against medical

advice or treatment, and thatI have not been diagnosed by a registered doctor as having a terminal illness.

In the event that I have an undiagnosed health condition as stated above, by signing this form, I choose to participate in the activity of Parasailing and agree to indemnify

and waive Sub Oceanic, its staff and employees, the Hotel Owning Entity and the Hotel of all responsibilities concerning any consequences that would result from my

actions. I further declare that in the event that I feel ill or unwell, have any physical complaints whatsoever or if an injury is sustained of any kind during the course of

Parasailing activities, I will notify Sub Oceanic Guide/Captain ofthe Parasail vessel immediately and before disembarking from the vessel / Hotel (Resort).

PHOTOGRAPHY/VIDEO RELEASE – ALL ACTIVITIES

The Participant hereby grants Sub Oceanic, its representatives, and employees the right to take photographs/videos of the Participant in connection with participant's

participation in the Activities. The Participant hereby authorizes Sub Oceanic to copyright, use and publish the same in print and/or electronically. Participant hereby

agrees that Sub Oceanic may use such photographs of the Participant for any lawful purpose, including but not limited to publicity, illustration, advertising, and web

content. By providing my contact details, I agree to be contacted by Sub Oceanic.

BINDING ARBITRATION - ALL ACTIVITIES

The Participant, and the Participant's parent(s) or legal guardian(s) (if the Participant is a minor) hereby agrees to submit any dispute, claim, or controversy, relating to

and/or arising from this agreement including the determination of the scope or applicability of this agreement to arbitration. Such disputes shall be referred to the

Maldives International Arbitration Centre (MIAC) in accordance with the MIAC rules in force at the time. Seat of arbitration shall be Maldives and the panel shall consist

of one arbitrator. Language of arbitration shall be English.

NOTICE TO PARTICIPANT

By signing this Agreement, you hereby forever release us and discharge any and all claims past, present, or future, demands, actions, causes of action, rights, damages,

costs, loss of services, expenses and compensation which you may have, or which may hereafter accrue or otherwise be acquired by you on account of or in any way

growing out of relating to or arising out of this agreement, provided that such release shall notin any way affect our right to enforce this agreement.

You unconditionally agree and accept that the signing of this agreement and the events leading to the signing of this agreement shall not be grounds to claim or shall not

be considered as a waiver of any of our rights nor shall be considered as a waiver of any of your obligations under this agreement.

All ofthe above is agreed to without prejudice to any of our rights under this agreement.

To the extent that any portion of this Agreement is deemed to be invalid under the law of the applicable jurisdiction, the remaining portions of the Agreement shallremain

binding and available for use by Sub Oceanic and its counsel in any proceeding.

The minimum age to participate in specific activities are as follows:

I HAVE READ AND UNDERSTAND THIS AGREEMENT AND I AM AWARE THAT BY SIGNING THIS AGREEMENT I MAY BE WAIVING CERTAIN LEGAL RIGHTS, INCLUDING THE RIGHT TO SUE. 

ADVICE ON CARRYING TODDLERS BELOW THE AGE OF 3 YEARS 

We allow toddlers below the age of 3 (three) years on our boats. However, we strongly advise against it due to several reasons such as but not limited to: 

·The balance system of small children is usually not yet stable and the risk of falling and injury is significantly higher due to the bobbing of the boat. 

·Infants do not fit into the regular life vests made for kids. It is dangerous for a child to wear a life jacket that does not fit. A poorly fitted life jacket that is too loose can slip off a child. Please provide your own life vest for such toddlers. It needs to be worn at all times while on the boat/relevant vessel. 

·Even with a life vest worn a small child below three (03) is more likely to suffer a more severe injury. 

·The exposure to sun is increased on the ocean and can be hard on the toddler’s skin and eyes. 

If toddlers are still present on the boat (against our advice) they need to be under direct supervision by a legal guardian at all times. Sub Oceanic shall not be liable for any incidents or occurrences.

I hereby assume all risk of injury or harm associated with the participation of the Activities and further agree to indemnity and forever release Sub Oceanic Adventures Private Limited (“Sub Oceanic”), its staff and employees, Hilton Amingiri Private Limited (the “Hotel Owning Entity”), its employees, Hilton Maldives Amingiri Resort & Spa (the “Hotel”), its staff and employees from any liability, claims or demands related to but not limited to any potential injuries, loss of life or damage to personal property, caused or sustained in connection with the participation ofthe Activities. 

I represent that I have read and fully understand the consequences of signing this statement and have done so voluntarily upon careful consideration.

I further state that I am fully aware of the risks associated with taking part in the activities.I further agree to indemnity and forever release Sub Oceanic Adventures Private Limited (“Sub Oceanic”), its staff and employees, Hilton Amingiri Private Limited (the “Hotel Owning Entity”), its employees, Hilton Maldives Amingiri Resort & Spa (the “Hotel”), its staff and employees from any liability, claims or demands related to but not limited to any potential injuries, loss of life or damage to personal property, caused or sustained in connection with the participation ofthe Activities. 

I represent that I have read and fully understand the consequences of signing this statement and have done so voluntarily upon careful consideration.

participation in the Activities and/or use ofthe Equipment, including while receiving instruction and/or training.

PARASAILING RELEASE OF LIABILITY, WAIVER OF CLAIMS, EXPRESS ASSUMPTION OF RISK ASSOCIATED WITH PARASAILING AND RELATED ACTIVITIES AND

INDEMNITY AGREEMENT

I hereby affirm and acknowledge that I have been fully informed of the inherent hazards and risks associated with parasailing and related water sport activities to which I

am about to engage.

DECLARATION OF FITNESS TO PARASAIL:

I hereby declare that I am physically fit and that I am not suffering or have suffered from any of the following conditions that could potentially endanger myself or others

whilst Parasailing such as but not limited to:

I hereby declare that I have no physical or mental condition that should preclude me from participating in my chosen activity, that I am not participating against medical

advice or treatment, and thatI have not been diagnosed by a registered doctor as having a terminal illness.

In the event that I have an undiagnosed health condition as stated above, by signing this form, I choose to participate in the activity of Parasailing and agree to indemnify

and waive Sub Oceanic, its staff and employees, the Hotel Owning Entity and the Hotel of all responsibilities concerning any consequences that would result from my

actions. I further declare that in the event that I feel ill or unwell, have any physical complaints whatsoever or if an injury is sustained of any kind during the course of

Parasailing activities, I will notify Sub Oceanic Guide/Captain ofthe Parasail vessel immediately and before disembarking from the vessel / Hotel (Resort).


PHOTOGRAPHY/VIDEO RELEASE – ALL ACTIVITIES

The Participant hereby grants Sub Oceanic, its representatives, and employees the right to take photographs/videos of the Participant in connection with participant's

participation in the Activities. The Participant hereby authorizes Sub Oceanic to copyright, use and publish the same in print and/or electronically. Participant hereby

agrees that Sub Oceanic may use such photographs of the Participant for any lawful purpose, including but not limited to publicity, illustration, advertising, and web

content. By providing my contact details, I agree to be contacted by Sub Oceanic.


BINDING ARBITRATION - ALL ACTIVITIES

The Participant, and the Participant's parent(s) or legal guardian(s) (if the Participant is a minor) hereby agrees to submit any dispute, claim, or controversy, relating to

and/or arising from this agreement including the determination of the scope or applicability of this agreement to arbitration. Such disputes shall be referred to the

Maldives International Arbitration Centre (MIAC) in accordance with the MIAC rules in force at the time. Seat of arbitration shall be Maldives and the panel shall consist

of one arbitrator. Language of arbitration shall be English.


NOTICE TO PARTICIPANT

By signing this Agreement, you hereby forever release us and discharge any and all claims past, present, or future, demands, actions, causes of action, rights, damages,

costs, loss of services, expenses and compensation which you may have, or which may hereafter accrue or otherwise be acquired by you on account of or in any way

growing out of relating to or arising out of this agreement, provided that such release shall notin any way affect our right to enforce this agreement.

You unconditionally agree and accept that the signing of this agreement and the events leading to the signing of this agreement shall not be grounds to claim or shall not

be considered as a waiver of any of our rights nor shall be considered as a waiver of any of your obligations under this agreement.

All ofthe above is agreed to without prejudice to any of our rights under this agreement.

To the extent that any portion of this Agreement is deemed to be invalid under the law of the applicable jurisdiction, the remaining portions of the Agreement shallremain

binding and available for use by Sub Oceanic and its counsel in any proceeding.

The minimum age to participate in specific activities are as follows:

I HAVE READ AND UNDERSTAND THIS AGREEMENT AND I AM AWARE THAT BY SIGNING THIS AGREEMENT I MAY BE WAIVING CERTAIN LEGAL RIGHTS, INCLUDING THE RIGHT TO SUE. 

ADVICE ON CARRYING TODDLERS BELOW THE AGE OF 3 YEARS 

We allow toddlers below the age of 3 (three) years on our boats. However, we strongly advise against it due to several reasons such as but not limited to: 

·The balance system of small children is usually not yet stable and the risk of falling and injury is significantly higher due to the bobbing of the boat. 

·Infants do not fit into the regular life vests made for kids. It is dangerous for a child to wear a life jacket that does not fit. A poorly fitted life jacket that is too loose can slip off a child. Please provide your own life vest for such toddlers. It needs to be worn at all times while on the boat/relevant vessel. 

·Even with a life vest worn a small child below three (03) is more likely to suffer a more severe injury. 

·The exposure to sun is increased on the ocean and can be hard on the toddler’s skin and eyes. 

If toddlers are still present on the boat (against our advice) they need to be under direct supervision by a legal guardian at all times. Sub Oceanic shall not be liable for any incidents or occurrences.


I hereby assume all risk of injury or harm associated with the participation of the Activities and further agree to indemnity and forever release Sub Oceanic Adventures Private Limited (“Sub Oceanic”), its staff and employees, Hilton Amingiri Private Limited (the “Hotel Owning Entity”), its employees, Hilton Maldives Amingiri Resort & Spa (the “Hotel”), its staff and employees from any liability, claims or demands related to but not limited to any potential injuries, loss of life or damage to personal property, caused or sustained in connection with the participation ofthe Activities. 

I represent that I have read and fully understand the consequences of signing this statement and have done so voluntarily upon careful consideration.
